1. Introduction
Welcome to Dot Appt Pty Ltd (ACN 676 911 130). These Terms and Conditions govern your use of our website and the services we provide. By accessing our website or using our services, you agree to be bound by these Terms and Conditions.
2. Services
Dot Appt Pty Ltd provides web design, development, SEO, and other related digital services as outlined in our packages and proposals. The scope of services for each project will be detailed in a formal proposal or statement of work agreed upon by both parties.
3. Online Presence Packages
Domains: All website packages include a standard domain name registration for one year. Domain names, including `.au` and `.com.au` TLDs, are subject to availability at the time of registration. Premium domain names, which have a higher registration cost, are not included in the standard package price and will incur additional fees.
.au Domains: For .com.au or .au domain registrations, the client must provide a valid and active Australian Business Number (ABN). The requested domain name must be an exact match, abbreviation, or acronym of the client's registered business name, or be closely and substantially connected to it, as per auDA (.au Domain Administration) policies.
eCommerce Platform Fees: For eCommerce packages, the quoted price covers the design and development of the online store. Monthly subscription fees for the underlying eCommerce platform (e.g., Shopify) are separate and payable directly by the client to the platform provider. We will advise on the most suitable platform and its associated costs.
Email Hosting: Included professional email addresses start with a 5GB storage limit per mailbox. Additional storage can be purchased for an extra fee.
Website Hosting & Storage: All website packages include hosting for the first year with a standard storage limit of 5GB. This is sufficient for most small to medium-sized business websites. Additional storage can be purchased if required.
Content & Copyright: The client is responsible for providing all website copy, content, and images. The client must guarantee they have the copyright for all provided media. Dot Appt Pty Ltd is happy to provide royalty-free images and placeholders if required.
4. Project Process & Delivery
Drafts: The Simple Website and Portfolio Website packages include two drafts. The first draft consists of the initial design sample delivered to the client for review. The client may provide one round of feedback for revisions, which constitutes the second draft. Further changes may incur additional fees.
1-Week Delivery: The "1-Week Delivery" timeline offered on certain packages is heavily dependent on the client. To meet this timeline, the client must provide all necessary information, content (text, images, logos), and feedback promptly upon request. Delays in client responsiveness will result in a corresponding extension of the delivery timeline.
5. Payment Terms
Fees for our services will be as quoted in our proposals. A deposit (typically 50%) is required before work commences. The final balance is due upon completion of the project, prior to the website going live. All prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless otherwise stated.
6. Intellectual Property
Upon receipt of final payment, Dot Appt Pty Ltd grants the client a non-exclusive, perpetual license to use the website and its design. We retain the right to showcase the project in our portfolio and marketing materials. Any third-party assets or software used are subject to their own licensing terms.
7. Client Responsibilities
The client is responsible for providing all necessary content (text, images, logos) in a timely manner. Delays in providing content may result in project delays. The client guarantees that all elements of text, images, or other artwork provided are either owned by the client, or that the client has permission to use them.
8. Limitation of Liability
To the maximum extent permitted by law, Dot Appt Pty Ltd shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.
9. Support and Maintenance
Our packages include a specified period of post-launch support as detailed on our website. This support covers bug fixes and minor technical issues. It does not cover new feature development, major design changes, or content updates beyond the included drafts. Ongoing maintenance plans are available for an additional fee.
10. Termination
Either party may terminate the project agreement with written notice. If the client terminates the agreement, the initial deposit is non-refundable. If Dot Appt Pty Ltd terminates the agreement, a pro-rata refund will be issued for any work not completed.
11. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of Australia, and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of any changes by posting the new Terms and Conditions on this page. You are advised to review these Terms and Conditions periodically for any changes.
